Consent and Release

This Consent and Release ("Consent") is entered into between the individual identified below (referred to herein as “I”) and TEAM 5 ROPERTIES, INC., A California Corporation d/b/a De Young Properties ("De Young Properties").

For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, I hereby grant to De Young Properties permission and consent, free of charge, to use my name, voice, visual image and likeness, and my comments (collectively, "my image"), in whole or in part, for any lawful purposes and in any form of media, including, but not limited to, the Internet, newsletters, advertisements, and the like, throughout the world in perpetuity. I understand that I shall not receive compensation for the use of my image, and that I shall have no right of consultation or approval in connection with any use of my image. I understand that any use of my image by De Young Properties will be in express reliance upon this Consent. I hereby release De Young Properties and its directors, officers, employees, agents, representatives, affiliated entities, licensees, assigns, and successors, from and against any and all claims, expenses (including attorneys' fees) or other liability arising from any and all uses of the rights granted to it under this Consent, including, without limitation, any claims or action based on libel, slander, defamation, right of privacy, "false light", California Civil Code Section 3344 or right of publicity. This Consent sets forth the entire agreement between De Young Properties and me with respect to the subject matter hereof and can only be modified in writing, signed by both parties. This Consent shall be governed by the laws of the state of California, and venue shall reside exclusively in Fresno County, California. I hereby confirm and acknowledge that I am not a minor, that I have been advised of my right to have an attorney review this Consent, that I have the authority to grant the rights herein and execute this Consent, and that I have read and do understand the contents of this Consent.
